A Durham nail salon discriminated against an HIV-positive client by denying him pedicures and must pay $ 7,500 in compensation, according to an agreement with the US government.

Tweetie Nails, which operates as Diva Nails on South Roxboro Street, is also to adopt and publish a non-discrimination policy that includes disabilities such as HIV and AIDS.

All salon staff should be trained in HIV / AIDS and disability discrimination in general, said the June rulebook, which the US Department of Justice released on Tuesday.

“The United States has determined that Diva Nails discriminated against the complainant by denying him manicure services because the complainant is HIV positive,” the settlement said. “Diva Nails has not demonstrated that treating the Complainant would pose a direct threat to the health or safety of others.”

The settlement stems from a complaint from the anonymous client, who was paying for his pedicure when another client he knew from the church asked aloud if the salon “was aware of his condition,” the settlement said. .

“The owner of Diva Nails followed the complainant outside, allegedly told him the owner knew the complainant had ‘AIDS’ and told him not to return to the salon,” the settlement said.

“Diva Nails denies refusing future services to the Complainant, but admits that her manager asked the Complainant if he was HIV-positive and requested a doctor’s note or other documents.

The regulation cites the Centers for Disease Control, which say people can only get HIV through sex; by direct contact with blood, organs or other tissues; or by a biological mother.

The North Carolina Board of Cosmetic Art Examiners states that salons should clean and disinfect all surfaces and tools at workstations between clients.

Tuan Ahn Trang, the member-owner named in the settlement, could not be reached on Wednesday. After several unanswered calls to Diva Nails, an employee suggested reaching him on Thursday.

With the settlement, the case is closed without civil action.
